Welcome to the JLab mobile application (the "App"), provided by PEAG LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of the App and its connection to compatible JLab hardware products ("Devices").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Description of Service
The App is designed to act as a companion to your compatible Devices, allowing you to configure settings, customize audio profiles, and manage firmware updates via local, short-range wireless communication technologies.
2. Hardware Data and App Analytics
Connected JLab hardware products do not independently generate, store, or transmit user data. All telemetry, usage metrics, and event data associated with your use of the products are generated solely through your interaction with the App. For detailed information on how this app data is collected, processed, and retained, please review our Privacy Policy (https://www.jlab.com/policies/terms-of-service).
3. Device Connectivity & Security
The App utilizes local wireless protocols to communicate with your Devices. You are solely responsible for ensuring you are in a secure physical environment when pairing your Device to the App to prevent unauthorized local interception. We are not responsible for any third-party interference that occurs due to unsecure local physical environments during the pairing process.
4. Acceptable Use
You agree not to:
• Use the App or connected Devices for any illegal or unauthorized purpose.
• Attempt to reverse engineer, decompile, or hack the App, the Devices, or the local wireless connection protocols.
• Use the App in a way that could disable, overburden, or impair the functionality of the App or the Devices.
5. Intellectual Property
All rights, title, and interest in and to the App (including all software, design, text, and graphics) are and will remain the exclusive property of PEAG LLC and its licensors.
6. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAG LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. We do not warrant that the App will be uninterrupted, error-free, or completely secure.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAG LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED $50.00 USD.
8. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of California, USA, without regard to its conflict of law principles.
• For EU/UK Consumers: If you are a consumer residing in the European Union or the United Kingdom, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
• Arbitration: Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in San Diego, California, except that either party may seek injunctive relief in court for intellectual property misuse. If you are a consumer residing in the European Union, this Arbitration section does not apply to you.
9. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms and, where required by law, providing an in-app notification. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.
